The ANC is planning to amend the South African Constitution drastically. According to them, this has to be done by means of a National Democratic Revolution, initiating a “second transitional phase” in South Africa. A number of fundamental parts of the Constitution have to be either scrapped, or amended according to this revolution. Although the Constitution has undergone small-scale changes a few times since 1994, the ANC is now planning drastic changes. Sections such as the right to private ownership of property are now under threat. The 1994 political settlement is regarded globally as an agreement between the former NP government, the current ANC government and other stakeholders. This settlement is embodied in the Constitution of South Africa. The ANC’s action will thus amount to a political breach of contract.

Die ANC beplan om die Suid-Afrikaanse Grondwet drasties te wysig. Dit moet volgens hulle deur middel van ʼn Nasionale Demokratiese Revolusie gedoen word om ’n “tweede oorgangsfase” in Suid-Afrika te begin. Ooreenkomstig hierdie revolusie moet ʼn aantal fundamentele dele van die Grondwet geskrap of gewysig word. Alhoewel die Grondwet sedert 1994 al reeds ʼn paar keer op klein skaal gewysig is, beplan die ANC nou om drastiese veranderings aan te bring en is artikels soos die reg op privaat besit van eiendom in gedrang. Die 1994-skikking word oor die wêreld heen as ʼn ooreenkoms tussen die voormalige NP-regering, die huidige ANC-regering en ander belanghebbende partye beskou. Hierdie skikking het in die Grondwet van Suid-Afrika neerslag gevind. Die ANC se optrede sal dus niks anders as politieke kontrakbreuk wees nie.
