2010 07 21 – AfriForum ready to challenge McBride appointment in court
AfriForum has instructed its legal team to prepare to have the possible appointment of Robert McBride as Tshwane’s metro police chief set aside in court, should the Tshwane Metro Council decide to appoint him. This comes after it became known that McBride was included in a short list of five candidates for this position.
AfriForum also directed a letter to the mayor of the Tshwane Metro Council, Dr Gwen Ramokgopa, which states that appointing McBride would be contrary to the South African Police Service Act 68 of 1995.
According to Nantes Kelder, AfriForum’s head of community safety, section 64 C of this act clearly stipulates that only a member of a municipal police service may be appointed as a chief executive of a municipal police service. “McBride left the Ekurhuleni Metro Police in 2008 and therefore lost his status as a member of a municipal police service,” Kelder added.
Kelder indicated that the position of Tshwane’s metro police chief was already shrouded in controversy by Commissioner Mpho Mmutle, who resigned earlier this year, and it is not in the public’s interest to fill the position with another controversial figure like McBride.
“Even if McBride is ultimately not convicted of drunken driving, AfriForum has enough information on McBride’s mafia-like conduct during his term as the Ekurhuleni metro police chief, which shows that he is not fit for the position,” Kelder said.
